Terms and Conditions

Welcome to Art by Sara Lind, owned and operated by Sara Lind Mortensen, an artist based in Denmark, currently not registered with a VAT number.
These Terms and Conditions apply to all purchases and services provided by Art by Sara Lind, whether through this website, point of sale, direct invoicing, or in-person transactions, for consumers located in Denmark, the EU, the United States, or internationally.
1. Products and Services
We offer:
- Original artwork: Unique, one-of-a-kind pieces created and shipped directly from Denmark.
- Print-on-demand products: Reproductions of Sara’s artwork, produced and shipped via third-party partners (e.g., Printify) based on your location.
- Commissions: Custom-made artworks created upon request according to your specifications.
- Art-related services: Personalized services related to Sara’s artwork, such as personal delivery, assistance with art selection, or other customized art-related services.
2. Prices and Payment
All prices are shown as total prices.
As a small startup in Denmark, Art by Sara Lind is currently not registered for VAT. Therefore, no VAT (moms) is charged on original artwork purchases, commissions, or art-related services.
For print-on-demand products, taxes (such as VAT, sales tax, or customs duties) may be collected at checkout by our printing and shipping partners, depending on your location.
You are responsible for any additional customs duties, import taxes, or fees charged upon delivery in your country.
Payment must be received in full before your order or service is processed, unless otherwise agreed (for example, in the case of deposits for commissions).
3. Shipping and Delivery
Original artworks are shipped from Denmark. Delivery times and costs vary by destination.
Local pickup or personal delivery by the artist may be available, depending on your location, and may incur additional service fees.
Print-on-demand products are fulfilled by international partners and shipped from locations closest to you. Delivery timelines depend on your region and product type.
We are not liable for delays caused by shipping providers, customs authorities, or third-party fulfillment services.
4. Commissions
Commissioned artworks are custom creations based on your preferences.
- A non-refundable deposit (typically 30–50% of the total price) is required before work begins.
- The remaining balance is due upon completion and acceptance of the final piece.
- Minor adjustments may be requested during the creative process, but significant changes outside the original agreement may incur additional costs.
- Once work has begun, the commission cannot be canceled, and the deposit will not be refunded.
Ownership of the physical commissioned artwork transfers to you upon full payment. However, copyright and all reproduction rights remain with Sara Lind Mortensen, unless otherwise agreed in writing.
You may not reproduce, sell prints, distribute copies, or use the artwork commercially without prior written permission.
If you wish to obtain exclusive rights to the commissioned artwork (meaning that Art by Sara Lind agrees not to create prints, reproductions, or derivative works based on the commissioned piece), this must be negotiated separately and agreed in writing before work begins. Exclusive rights do not transfer copyright or ownership of intellectual property; they solely restrict Art by Sara Lind from making copies of the specific commissioned work. Exclusive rights require an additional fee.
5. Art-Related Services
Art by Sara Lind offers art-related services, such as personal delivery of artworks, assistance with selecting artwork for private or commercial spaces, and other customized services connected to Sara’s artwork.
- Service details, pricing, and timelines are agreed individually before booking.
- Services must be prepaid unless otherwise agreed in writing.
- Cancellations must be made at least 24 hours in advance to receive a full refund. Later cancellations are non-refundable.
- Travel expenses may apply for in-person services and will be agreed upon beforehand.
Advice or suggestions provided during services are based on personal, creative opinion. Sara is not liable for dissatisfaction with recommendations or for decisions made based on her advice.
6. Right of Withdrawal (For EU Customers)
Under EU law, you have a 14-day right of withdrawal for most purchases.
Exemptions:
The right of withdrawal does not apply to:
- Custom-made or personalized items (e.g., commissioned artworks, print-on-demand products made specifically for you)
- Digital downloads (after access)
- Art-related services that have already been provided
To exercise your right of withdrawal, contact us within 14 days of receiving your order. Returned items must be unused, undamaged, and in their original packaging.
You are responsible for the cost and risk of return shipping.
7. Returns and Refunds
If your item arrives damaged, defective, or incorrect, please contact us at info@artbysaralind.com within 14 days of receiving your order.
Please include your order number, a description of the issue, and clear photographs of the product and packaging.
- For original artworks, we may require the item to be returned in its original condition before issuing a refund or replacement. If the returned artwork shows signs of use, damage, or diminished value, we reserve the right to deduct an appropriate amount from the refund or, in severe cases, deny the refund entirely.
- For print-on-demand products, returns and issue resolutions are handled in accordance with the return policies of our production partners, specifically Printify.

Print-on-demand products are made to order and are otherwise non-returnable unless they are defective or incorrect. - Commissioned artworks and completed art-related services are non-refundable, unless otherwise agreed in writing.
8. Intellectual Property
All artworks, images, and content on this site are the property of Sara Lind Mortensen.
Ownership of a physical artwork does not include the transfer of copyright.
You are welcome to share photos of your purchased artwork for personal, non-commercial purposes, such as on social media.
However, you may not reproduce, distribute, create derivative works, sell prints, or use the artwork for commercial purposes without prior written permission.
8.1 Reputational Protection and Buy-Back Rights
To protect the integrity of her work and reputation, Sara Lind Mortensen reserves the right to request the return of any original artwork if the current owner becomes associated with public actions or statements that may significantly damage the artist’s reputation or the perceived value of the artwork.
In such a case, Sara Lind Mortensen may offer to repurchase the artwork at the original sale price paid by the owner.
The owner agrees to negotiate in good faith and to give priority to our repurchase request over any resale or transfer to third parties.
This right applies only to original artworks, not to print-on-demand products or reproductions.
9. Limitation of Liability
Neither Art by Sara Lind nor Sara Lind Mortensen shall be liable for indirect, incidental, or consequential damages, including lost profits, even if such damages were foreseeable.
Our total liability for any claim shall not exceed the amount you paid for the item or service in question.
10. Governing Law and Jurisdiction
These Terms are governed by Danish law.
Disputes that cannot be resolved amicably shall be settled by the Danish courts, unless you reside in another EU country, in which case you may also bring a claim before your local courts under EU consumer protection law.
11. Consumer Rights
Nothing in these Terms limits your rights under applicable consumer protection laws in your country of residence.
These Terms comply with the EU Consumer Rights Directive and Danish consumer protection legislation.
